Amendments have been made to CPR Rule 3 and Practice Direction 3E with effect from 1st October 2020.
The new Precedent T annexed to Practice Direction 3E is to be used in the event of a variation of a budget pursuant to Rule 3.15 A.
In addition, Practice Direction 3E paragraph 13 now applies in relation to “oppressive behavior”. Any party may now apply
to the Court if it considers that another party is behaving oppressively in seeking to cause the Applicant to spend money disproportionately on costs and the Court will grant such relief as may be appropriate.
It could be the case that there may now be satellite litigation in relation to this issue.
